Terms of service

1. Subscription agreement

These leasing terms and conditions comprise the part of the Subscription Agreement concerned with the designer furniture (hereinafter always and simply “Leased Products”) leased by the consumer (hereinafter “the Lessee”). Upon acceptance of the Subscription Agreement, the Lessee confirms that the Lessee understands and accepts Skagerak RENT, whose pricing scheme does not distinguish between new and used furniture. The Lessee likewise confirms by acceptance of the Subscription Agreement that s/he is 18 years old or over, which is a precondition for entering into the Subscription Agreement.

The Agreement is entered into between the Lessee and Fritz Hansen, Vinkel Allé 1, 9000 Aalborg, bus.reg.no.: 14120211. The terms and conditions of this Agreement may only be changed by written Agreement between Fritz Hansen and the Lessee, unless otherwise indicated in the provisions below. 

2. Ownership and Right of Use

Ownership

The ownership of the Leased Products remains with Fritz Hansen, and the Lessee’s payment of the subscription fee does not imply that the Lessee becomes whole or part owner of the Leased Products. The Lessee may therefore not sell, mortgage or otherwise exercise legal rights over the Leased Products. The Lessee also accepts that Fritz Hansen is at all times entitled to demand proper documentation of the location and current condition of the Leased Products, if this is done with reasonable notice and with loyal respect for the Lessee’s circumstances. If the Lessee, without reasonable grounds, fails to comply with a request to present proper documentation of the location of the Leased Products, Fritz Hansen is entitled to demand submission of the Leased Products for closer inspection. 

Right of Use

The Lessee only has right of use to the Leased Products. The Leased Products may not be subleased, loaned or otherwise entrusted or transferred in whole or in part to any third party, unless this has previously been agreed in writing with Fritz Hansen. This Subscription Agreement does not give the Lessee the right in any way to process, alter or replace parts of the Leased Products. Nor must the manufacturer’s number, type designation etc. that serve to identify the Leased Products be removed or otherwise altered. Nor may the Leased Products be removed from the agreed delivery address, unless this has previously been agreed in writing with Fritz Hansen. 

3. Price and Subscription Fee Payment

The Lessee pays a monthly subscription fee for renting the Leased Products, to be paid monthly in advance. The fixed subscription fee includes: 
Upon entering into the Subscription Agreement, the Lessee pays separately for delivery and return of the Leased Products: see the applicable prices below. The details regarding return of the Leased Products upon expiry of the Subscription Agreement are to be agreed separately between the Lessee and Fritz Hansen: see Clause 11. The Lessee does not have the option of returning the Leased Products himself/herself. 

Prices for delivery and collection

Denmark
Delivery or return: DKK 695 incl. VAT per delivery (upon signing the Agreement, the sum of DKK 1390 incl. VAT is payable by way of prepayment for both the delivery and return of the furniture). 

Norway
Delivery or return: NOK 1750 incl. VAT per delivery (upon signing the Agreement, the sum of NOK 3500 incl. VAT is payable by way of prepayment for both the delivery and return of the furniture). 

When ordering goods for delivery in Norway, all taxes are included. Therefore, no extra import duties and/or taxes will be added to your order.
 
Sweden
Delivery or return: SEK 1750 incl. VAT per delivery (upon signing the Agreement, the sum of SEK 3500 incl. VAT is payable by way of prepayment for both the delivery and return of the furniture). 

Eurozone
For countries in the Eurozone including: Finland, Germany, Ireland, Netherlands, Belgium, Austria, Italy, France, Spain, Portugal, Estonia, Latvia, Lithuania, Luxembourg, Poland, Slovakia, Hungary, Croatia, Romania, Bulgaria, Czech Republic.

Delivery or return: EUR 167,5 incl. VAT per delivery (upon signing the Agreement, the sum of EUR 335 incl. VAT is payable by way of prepayment for both the delivery and return of the furniture). 

Great Britain and North Ireland
Delivery or return: GBP 147,5 incl. VAT per delivery (upon signing the Agreement, the sum of GBP 295 incl. VAT is payable by way of prepayment for both the delivery and return of the furniture). 

When ordering goods for delivery in Great Britain and North Ireland, all taxes are included. Therefore, no extra import duties and/or taxes will be added to your order.

Payment

On skagerak.com you can pay with Dankort, Visa/Dankort, Mastercard, Maestro, Visa Electron, MobilePay and Ideal.

Upon signing the Subscription Agreement, the Lessee gives his/her consent, in the context of the first payment, that Fritz Hansen may in future charge payments to the Lessee’s payment card until the Subscription Agreement expires following the Lessee’s cancellation thereof.

After the first payment, a monthly invoice will be sent by email with a receipt for completed payment. 

If the registered payment card is nearing its expiry date, is blocked or if there are changes to the card data, Fritz Hansen will send an email reminder, and the Lessee must thereafter log in to skargerak.com/rent and register a new payment card. 

Fritz Hansen uses QuickPay as their payment gateway. QuickPay is responsible for the encrypted transaction between your payment card and the payment card processor. Read more about secure online payments at quickpay.dk.

4. Insurance

Upon signing this Subscription Agreement, the Leased Products are covered by an insurance policy Agreement between Fritz Hansen and their insurance provider. 

The insurance policy covers sudden and unexpected damage, and fire and water damage. 

If an accident occurs and the Leased Products are damaged, the Lessee is obligated to contact Fritz Hansen Customer Service immediately at info@fritzhansen.com

Damage, which is not covered by the insurance:
In the above instances, where the insurance does not cover damage sustained by the Leased Products, the Lessee must bear the costs of remedying the damages, repairs etc. of the Leased Products. 

Upon signing the Subscription Agreement, the Lessee confirms that s/he has read the above insurance conditions, including the situations and instances, in which the insurance does not cover damage sustained, and in which it is therefore incumbent on the Lessee to bear the costs of repair. 

We refer also to Clause 8.

5. Delivery of the Leased Products

Denmark
Fritz Hansen delivers to addresses in Denmark (excluding Greenland and the Faroe Islands). Fritz Hansen employs the distribution company, LKMM for delivery of the Leased Products. The details of the delivery will be agreed separately between the Lessee and LKMM after the signing of this Subscription Agreement. Fritz Hansen endeavours to ensure that LKMM contacts the Lessee within 48 hours of signing the Subscription Agreement. 
 
Eurozone, Norway, Great Britain, and North Ireland
Fritz Hansen delivers Leased Products in the Eurozone, Norway, Great Britain, and North Ireland. Our carrier will contact the Lessee within two working days to arrange the delivery. The details of the delivery will be agreed separately between the Lessee and the carrier. Fritz Hansen endeavours to ensure that the carrier contacts the Lessee within 48 hours of signing the Subscription Agreement. 

Delivery time

Delivery time is seven days maximum, but for delivery to non-bridged islands a longer delivery time should be allowed for, though 14 days maximum. Delivery will be made to the address provided when entering into the Subscription Agreement. See the applicable conditions below, unless otherwise separately agreed between the Lessee and Fritz Hansen. For the delivery, the Lessee shall pay the price previously agreed, when entering into the Subscription Agreement. The detailed prices for delivery and return are:

Delivery and Collection Conditions

Denmark
The Lessee is obligated to ensure that LKMM can carry out the delivery of the Leased Products by giving access to the Lessee’s premises within the agreed delivery times. The Lessee is also responsible for ensuring that there is adequate space and access for the Leased Products to be delivered to the Lessee’s property. If delivery requires a special delivery method, for example, the use of a lift or similar, the Lessee must bear the costs. LKMM delivers both to ground level and to multi-floor properties. In this regard, the Lessee must remember that carriers employed by LKMM are, due to safety regulations, compelled to wear safety shoes, which they may not be requested to remove on entry to the Lessee’s residential property. 
 
Eurozone, Norway, Great Britain, and North Ireland
The Lessee is obligated to ensure that the carrier can carry out the delivery of the Leased Products by giving access to the Lessee’s premises within the agreed delivery times. The Leased Products will be delivered to the Lessees doorstep. The Lessee must be present upon delivery. 

6. Entry into Force and Termination of the Subscription Agreement

The lease period commences on the day the products are delivered, though no later than 14 days after signing the lease Agreement. The first payment is charged to the credit card upon entering into the Agreement, when the furniture has left Fritz Hansen’s warehouse. 

The Lessee may terminate this Agreement with one month’s notice from the end of the month after two months have passed following the signing of the contract (“binding period”). After the binding period, the Subscription Agreement is automatically renewed each month, unless the Lessee actively terminates the Subscription Agreement. 

The subscription can be terminated by writing to Fritz Hansen Customer service at info@fritzhansen.com, stating that the Lessee wishes to terminate the subscription. Always remember to give your customer number when contacting Customer Service; this can be found on your monthly invoice. For collection of the Leased Products, see Clause 11. When your termination of the Subscription Agreement has been registered by Fritz Hansen, you will receive a confirmation receipt by email. 

If you want to purchase the Fritz Hansen product after leasing, please see Clause 13 for further information.

During the binding period, Fritz Hansen may only terminate the Subscription Agreement in the event of the Lessee’s material breach (see Clause 10), or if Fritz Hansen ceases to operate Fritz Hansen (see Clause 7). After expiry of the binding period, Fritz Hansen may at any time terminate the lease Agreement with 1 month’s notice from the end of the month.


7. Changes to the Subscription Agreement

Fritz Hansen is entitled to change the terms of the Subscription Agreement, including prices, if this is deemed necessary based on events such as, though not limited to: regulatory changes, competitive conditions, price inflation or other externally originating circumstances or expenses. In the event of material changes, the Lessee has the right to receive notification individually about the change no later than two months before the change comes into effect. In the event of material changes, including price changes, the Lessee is entitled to terminate the Agreement such that the termination is effected no later than the same day the change comes into force. If the Lessee does not terminate the Subscription Agreement before expiry of the notice, this shall be deemed to be acceptance of the change, which will hereafter have effect for the Lessee. Fritz Hansen may only make price increases during the binding period, if this is necessary due to regulatory changes, including, for example, changes to taxation and tariff conditions. 

In the event that Fritz Hansen decides to halt distribution of products from skagerak.com and thereafter no longer offers Subscription Agreements through the Skagerak platform, Fritz Hansen is at all times entitled to terminate the Subscription Agreement with the Lessee with one month’s notice from the end of the current month, unless this is during the binding period. However, in the event of termination during the binding period, Fritz Hansen is obligated to bear the costs of return delivery of the furniture, notwithstanding the provisions of Clause 11.

8. The Lessee’s Responsibility Under the Subscription Agreement

In addition to payment of the monthly subscription fee (see Clause 3), the Lessee has the following obligations under the Subscription Agreement: 

The Lessee is responsible for treating the furniture in accordance with ordinary usage. Fritz Hansen has the following guidelines on the correct use of the Leased Products, and the Lessee is at all times obligated to treat the Leased Products in accordance with the usage described therein. Fritz Hansen retains the right to lodge a claim should the Leased Products at the expiry of the Subscription Agreement be damaged to any extent other than that which can be ascribed to regular wear and tear, and which is due to usage contrary to the guidelines.

The Lessee can thus be charged costs for rectification, repair or similar of the Leased Products, if the damage is not covered by the insurance policy: see Clause 4 above, ‘Insurance’. The costs will not exceed the product’s indicative sale price. 

If an accident occurs and one or more of the Leased Products is/are damaged, as well as in the event of theft of one or more of the Leased Products, the Lessee is obligated to notify Fritz Hansen Customer Service immediately at info@fritzhansen.com. 

Warranty on Leased Products

If there are defects in the Fritz Hansen products you have leased, we comply with all statutory warranty rules. If you want to complain about obvious material or manufacturing defects in items we have delivered, including damage caused during transportation, please contact us immediately.

9. The Lessor’s Responsibilities Under the Subscription Agreement

Fritz Hansen undertakes to deliver the Leased Products in working order and in such a condition the Lessee may rightly expect in accordance with Skagerak RENT. Fritz Hansen is further obligated to perform any necessary service on the Leased Products after the end of the lease period. 

In the event of a defect or defects, for which Fritz Hansen is responsible, and which entail that the Leased Products are not in working order, Fritz Hansen is obligated to rectify the defect/s. In this context, Fritz Hansen will evaluate which type of remedy is required and whether the product should be exchanged, repaired etc., if the chosen solution can be implemented within a reasonable time, and without cost or significant disadvantage for the Lessee. 

Fritz Hansen is not responsible for any non-fulfilment or delays in accordance with the Subscription Agreement that are caused by circumstances beyond the control of Fritz Hansen (force majeure). Force majeure includes any action, event, failure or accident beyond Fritz Hansen’s reasonable control, including, but not limited to: fire, war, terrorist attack, explosion, collective action such as a strike or lockout, seizure, storm, flood, natural disasters or other extraordinary events. The services that Fritz Hansen must perform under the Subscription Agreement are deemed to be suspended for the period in which the force majeure event persists. Fritz Hansen undertakes to make every reasonable effort to bring the force majeure event to a close, or to find a solution, through which the obligations under the Subscription Agreement may be fulfilled despite the force majeure event. Fritz Hansen also makes reservations for any pricing and typological errors, technical failures and products that are sold out. 

10. Termination of the Subscription Agreement by Breach

In the event of the Lessee’s material breach of the Subscription Agreement, Fritz Hansen is entitled to cancel the Agreement. Under all circumstances, it will be deemed material breach if the Lessee: 
It should be noted that the above-named examples do not constitute an exhaustive list. In the event of the Lessee’s material breach, Fritz Hansen also reserves the right to claim compensation for its loss in accordance with the general rules of Danish law.

11. Return of the Leased Products Upon Termination of the Subscription Agreement

Following termination of the Subscription Agreement, whether this be due to the Lessee’s or Fritz Hansen’s termination or cancellation of the lease Agreement, the carrier will collect the Leased Products from the Lessee’s property. The carrier will contact the Lessee 14 days before the expiry of the Subscription Agreement, after which a collection date will be agreed. This time must be no later than seven days following expiry of the Subscription Agreement. Otherwise, the termination is deemed to be annulled. The carrier then returns the products to Fritz Hansen, who then prepare a final report on the products, thereby also examining the condition of the products. The Lessee will then receive a receipt from Fritz Hansen that the products have been returned. Upon signing the Lease Agreement, the Lessee has paid for the collection of the products.

12. Right of Revocation

Under the Danish Consumer Protection Act, the Lessee has the right to revoke this Agreement within 14 days after the day when the Lessee, though not freight carrier or transporter, receives the product into his/her physical possession. 

To exercise the right of revocation, the Lessee must notify Fritz Hansen of his/her decision to revoke the Agreement in an unambiguous declaration. the Lessee can revoke the signed Agreement by writing an email to info@fritzhansen.com referencing the customer number. If the Lessee exercises this option, the Lessee will immediately receive confirmation that the Lessee has exercised his/her right to revoke. the Lessee may also use the standard revocation form, without this being obligatory. The revocation deadline is complied with if the Lessee sends his/her notice of exercise of the right of revocation before the revocation period has expired. 

If the Lessee exercises his/her right of revocation within the deadline, Fritz Hansen will reimburse payment received for rent to the Lessee. However, the Lessee must bear the costs of delivery and return. The refund will be made without undue delay and in all cases no later than 14 days from the date on which Fritz Hansen received the Lessee’s notice that the Lessee wishes to revoke the Agreement entered into. Fritz Hansen will make the repayment without the addition of fees and using the same means of payment that the Lessee used in his/her purchase, unless the Lessee has expressly consented to another means. 

Please note that the Lessee bears all costs for the return of the Leased Products. The applicable delivery and return prices can be seen here. The Lessee is liable for any impairment in the value of the Leased Products due to handling other than that which is necessary to determine the nature, properties and manner of operation of the products. Fritz Hansen will assess any impairment. 

13. Buyout Purchase After the Lease Period

In this section, you will find the specific terms that apply when you choose to purchase your leased furniture after the lease period (hereafter referred to as “Buyout after Rental Option”).

The Buyout after Rental Option is available to you when you lease products from Fritz Hansen. All Fritz Hansen’s Leased Products are available for purchase after rental. 

If you want to purchase the leased product(s) after the lease period, please contact Fritz Hansen Customer Care at info@fritzhansen.com. 

Leased Products from Fritz Hansen are either new or have been used for rental before. All Fritz Hansen products are sold on an “As-Is” basis. If there are defects in the Fritz Hansen products that you have bought, we comply with all statutory warranty rules. Since you have the Fritz Hansen rental furniture in your possession at the time of purchase, you are aware of the condition of the products at the time of purchase. 
 
To avoid doubt, the purchase of leased furniture from Fritz Hansen in accordance with this clause is not considered a distance sale, as you have the furniture in your possession when the purchase is made. This means that you cannot return or withdraw from purchase of the Fritz Hansen products after exercising the Buyout after Rental Option. 

Prices and Payment

The price of Fritz Hansen's products is calculated by deducting the paid leasing fees and shipping costs from the products’ indicative sale price. For more information on the exact price, please contact Customer Service at info@fritzhansen.com.

If you choose to exercise the Buyout after Rental Option, an invoice will be sent to you to pay for the furniture. 

Transfer of Ownership

When you have exercised the Buyout after Rental Option and paid the Purchase Price, the Fritz Hansen products will no longer be the property of Fritz Hansen and will be referred to as “Purchased Products”. This also means that the loss of, or damage to the Purchased Products will not be covered by our insurance, and that all risk of loss, damage, accidental destruction and similar transfers to you.

14. Privacy Policy and Processing of Personal Data

Processing of Personal Data

Personal data is processed confidentially and stored securely in compliance with applicable regulations. The Lessee is at any time entitled to request access and to correct his/her data by contacting Fritz Hansen. The data is used to manage the Lessee’s subscription, to process orders and payments, for any participation in competitions and for information and marketing via telephone, post, email and text to the extent the law permits. If the Lessee does not wish to receive information, offers, benefits and new initiatives from Fritz Hansen, the Lessee may change his/her personal details by contacting Fritz Hansen’s Customer Care. 

15. Complaints and Contact with Fritz Hansen’s Customer Care

The Lessee may contact Fritz Hansen’s Customer Care at info@fritzhansen.com if the Lessee has any questions about the subscription or if the Lessee wishes to make a complaint about Fritz Hansen. In the first instance, always refer subscription complaints to Fritz Hansen’s Customer Care. 

Fritz Hansen's decisions regarding complaints may be brought before the Danish Dispute Resolution Centre (Center for Klageløsning) at the House of Committees (Nævnenes Hus), Toldboden 2, 8800 Viborg. Complaints cases can be lodged via the following website: klagonline.forbrug.dk. If a resolution cannot be reached in cooperation with the Danish Dispute Resolution Centre, the Lessee has the option of bringing his/her complaint before the Danish Consumer Complaints Board (Forbrugerklagenævnet) at the House of Committees (Nævnenes Hus), Toldboden 2, 8800 Viborg via the website: www.forbrug.dk 

The EU Commission’s online complaints portal can also be used to lodge a complaint. Complaints can be lodged here: http://ec.europa.eu/odr. When lodging a complaint, the Lessee must enter Fritz Hansen’s email address: info@fritzhansen.com
